Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. Where a referral fee is paid to a third party, this fee is paid by ourselves up to a maximum of £75 + VAT without any cost to yourselves.

If we find any additional expenses need to be incurred after we have considered the contract, searches and title documents, we shall let you know the reason for the extra expense, the likely amount, and when we shall need payment. 

If this transaction does not proceed to completion then our charges will be a minimum of £100+VAT plus any disbursements and the maximum charge will not exceed our quoted fee and will be based on the amount of work undertaken on your behalf.

  • The precise stages involved in the sale of a residential property vary according to the circumstances. However, a brief outline is as follows: 
  • Take your detailed instructions
  • Obtaining Deeds and up to date Land Registry details 
  • Preparing and submitting draft Contract with standard Law Society protocol Property Information forms 
  • Replying to standard preliminary enquiries 
  • Effecting Exchange of Contracts and receipt of deposit 
  • Deducting Title 
  • Approving draft Transfer and arranging for this to be signed by you in readiness for completion 
  • Replying to Requisitions on Title and preparing Completion Statement 
  • Obtaining redemption figures on First Charge 
  • Completing the sale and collecting the proceeds 
  • Redeeming First Charge and sending confirmation of the Discharge to the Buyers Solicitor
  • Paying your Estate Agent 
  • Preparing Completion Statement and accounting to you the net proceeds of the sale

How long will my house sale take?

The average process takes between 6-8 weeks. It can be quicker or slower, depending on the parties in the chain. For example, if you are selling to a first time buyer, selling a new build property, it could take 10 weeks. However, if you are selling a leasehold property that requires an extension of the lease, this can take significantly longer, between 3 and 6 months. In such a situation additional charges would apply.

What Is Not Included In Our Quoted Fees
  • Settling fees to Lender for release of deeds
  • Dealing with a second Charge or subsequent Charges 
  • Work relating to the release of Collateral security 
  • Obtaining Retrospective Consents for Planning Permission, Building Regulations, Restrictive Covenants or similar or obtaining Indemnity Insurance in
    respect of any of these
  • Obtaining Good Leasehold Title or Absentee Landlord Indemnity Insurance
  • Enhancing title by Statutory Declaration or similar 
  • Boundary disputes or joint driveway problems
